This Privacy Policy explains how we collect, use, disclose, and safeguard information when you visit our website, contact us, or use our therapy and coaching services.

This policy applies to information collected through our website and intake process. Protected health information created or maintained in the course of providing clinical care is governed by our separate Notice of Privacy Practices (NPP), provided to clients at the start of services and available on request.

• Reason for seeking care

Information collected during intake (after you begin services):

• Mailing address
• Mental health history
• Emergency contact details
• Current or prior provider information
• Referral source

• Other clinical information relevant to your care

Payment information:

• We collect payment information so that we can process payments for services on your behalf through our automated system. Card details are entered into our practice management platform Jane.app via Stripe, and are not visible to or stored by our staff. They are held in encrypted, tokenized form by our PCI-compliant payment processor.

Information collected automatically:

• General location data (such as city) and analytics data, collected through cookies and similar technologies via Google Analytics and Google Ads.

3. Cookies and Tracking Technologies

Our website uses cookies and similar technologies to understand site traffic, measure advertising performance, and improve user experience. These tools may collect data such as your general location, device information, and how you interact with our site.

You can control or disable cookies through your browser settings. You may also opt out of Google Analytics tracking using the Google Analytics Opt-Out Browser Add-on, and adjust ad personalization through Google Ads Settings. Disabling cookies may affect how parts of our website function.

5. How We Share Your Information

We share limited information with encrypted, trusted third-party service providers who help us operate our practice. Each of these providers that handles protected health information has signed a Business Associate Agreement (BAA) with us, as required under HIPAA. These include:

• Jane.app (practice management and scheduling, with payment processing through Stripe): basic identifying information, contact information, and payment information
• Google Workspace (email and communication): contact information and communication history
• Zoho Bigin: contact information and communication history

We do not sell your personal information. We do not share your information for third-party marketing purposes.

6. Third-Party Links

Our website may contain links to third-party websites or services that we do not own or control. This Privacy Policy does not apply to those sites. We encourage you to review the privacy policies of any third-party site you visit.

7. Data Storage and International Transfers

We are a clinical practice operating in the United States while also operating in Canada. Some of our service provider vendors store data in Canada, the United States, or other regions, depending on their infrastructure and our account configuration. Our US clinical records in our practice management platform are stored in a US-based data centre. By using our services, you understand that your information may be transferred to, stored in, and processed in jurisdictions outside your own, including Canada, subject to appropriate safeguards.

8. Data Retention

We retain client contact information and communication history in our email and contact-management systems for as long as needed to provide services and meet our legal obligations.
Clinical records are retained in accordance with applicable legal and professional record-keeping requirements. We are required by law to retain treatment records for a minimum period (generally seven years, and longer in certain circumstances) and cannot delete records before that time. Clients may request to be discharged, after which their file is closed and made inactive, but the record is retained as required by law.

9. Your Choices and Rights

• You may log in to your client account to view and update your personal information.
• You may unsubscribe from our email communications at any time by clicking the unsubscribe link or emailing us directly, and we will remove you from our marketing list.
• You may request access to your health records or request corrections in accordance with HIPAA and applicable law. Because we are legally required to retain clinical records, we cannot delete them on request.

Note on California residents: Personal health information governed by HIPAA is exempt from the California Consumer Privacy Act. To the extent any non-health information we collect is subject to the CCPA, California residents may contact us to exercise applicable rights.

10. Children’s Privacy

We provide services to clients who may be minors, including young children, when arranged and consented to by a parent or legal guardian. We do not knowingly collect personal information directly from children through our website without parental or guardian involvement. Intake and clinical information for minor clients is collected and managed with appropriate consent.

11. Security

We take the protection of your information seriously. Our safeguards include:

• Encryption of data in transit and at rest through our service providers
• Two-step verification required for all staff accounts in our Google Workspace environment
• A data protection policy that all staff have read and signed
• Role-based access controls limiting who can view client information
No method of transmission or storage is completely secure, but we work to protect your information using reasonable and appropriate safeguards.

12. Changes to This Policy

We may update this Privacy Policy from time to time. If we make a material change, we will notify active clients on our email list by email. The effective date at the top of this policy indicates when it was last revised.
